Digital Product License

This Digital Product License applies to downloadable and digital materials sold or distributed by Dani Elle Mentorship & Consulting, including products purchased through this website or any authorized third-party marketplace.

By purchasing, downloading, accessing, or using a digital product, you agree to the terms of this license.

1. Ownership

All digital products remain the intellectual property of Danielle Virnelson (DBA Dani Elle Mentorship & Consulting) unless otherwise stated.

Purchasing or downloading a product grants you a limited license to use the material. It does not transfer copyright, ownership, authorship, trademark rights, or other intellectual property rights.

All rights not expressly granted under this license are reserved.

2. Individual-Use License

Unless a product description explicitly states otherwise, each purchase includes a license for use by one individual purchaser.

Under an individual-use license, you may:

  • Download and store the product on your personal devices

  • Print copies for your own professional use

  • Edit or customize editable materials for your own use

  • Use the material with clients, supervisees, students, or staff members you directly support, when the product is designed for that purpose

  • Use completed worksheets, forms, or handouts within your own professional practice

  • Reference the material when planning your own work

The purchaser must remain the primary user of the product.

3. Permitted Client and Participant Use

When a product is designed for use with clients, caregivers, supervisees, trainees, students, or participants, the purchaser may provide copies necessary for that intended use.

For example, an individual purchaser may:

  • Provide a worksheet to a client or caregiver

  • Use a supervision form with their own supervisee

  • Distribute a handout during a meeting they personally facilitate

  • Use a template to create documentation for their own cases

  • Present a completed resource to the team directly assigned to a client

This permission does not allow the purchaser to distribute the original editable files, templates, or full product package to others.

4. Prohibited Sharing

You may not share, transfer, or distribute the original product files to another person or organization unless you have purchased an appropriate multi-user or organizational license.

Prohibited sharing includes:

  • Emailing files to colleagues

  • Uploading files to a shared company drive

  • Posting files in Microsoft Teams, Google Drive, Dropbox, SharePoint, Slack, or another shared workspace

  • Adding materials to an employee resource library

  • Uploading products to a learning-management system

  • Sharing login credentials or download links

  • Providing editable files to clients, trainees, supervisees, or coworkers

  • Printing copies for unrestricted use by other professionals

  • Sharing products within social-media groups, professional groups, or online communities

Each professional who wishes to independently access or use the original product must purchase their own license unless another license type is available.

5. Organizational and Team Use

Use by multiple employees, contractors, departments, locations, or organizational representatives requires an organizational or multi-user license.

Organizational use includes:

  • Adding products to an internal clinical resource library

  • Providing materials to multiple BCBAs, RBTs, supervisors, trainees, or employees

  • Using products across multiple teams, clinics, schools, or locations

  • Incorporating materials into company training or onboarding

  • Uploading products to an internal drive, intranet, or learning platform

  • Adapting materials for organization-wide use

  • Using a product as part of a standardized company process or curriculum

Organizational licenses may be priced based on the number of users, employees, locations, programs, or intended uses.

6. Training and Presentation Use

An individual-use license does not automatically permit use of the product in paid or organization-wide trainings.

You may not:

  • Use the product as the primary content of a paid course or workshop

  • Present the original slides or materials as your own

  • Distribute files to training attendees

  • Incorporate the product into a CEU, PDU, webinar, conference presentation, course, membership, or training program

  • Use the product to create materials for resale or paid distribution

Written permission or a separate commercial, presentation, or training license is required for these uses.

Limited reference to a resource during a meeting or training may be permitted when the product is properly attributed and is not distributed, reproduced, or presented as original work.

7. Editing and Customization

Editable products may be modified for the purchaser’s permitted personal or professional use.

You may:

  • Add your name or professional information

  • Enter client-specific or organization-specific information

  • Adjust wording to fit an individual situation

  • Change formatting for accessibility or implementation

  • Remove sections that are not relevant to your intended use

Editing a product does not create a new work that you may sell, distribute, publish, sublicense, or claim as your own.

Copyright and ownership remain with Dani Elle Mentorship & Consulting.

8. Branding and Attribution

You may not remove copyright notices, licensing language, watermarks, logos, credits, or other ownership information unless the product description specifically permits removal or customization.

When attribution is required, use wording such as:

Resource adapted from materials created by Dani Elle Mentorship & Consulting.

Permission to add your own branding does not transfer ownership of the underlying content.

9. Clinical and Professional Use

Digital products are educational and professional resources. They are not substitutes for individualized clinical assessment, professional judgment, informed consent, legal review, or compliance with applicable standards.

Purchasers are responsible for reviewing and adapting products to ensure they are appropriate for:

  • The intended client or participant

  • Their scope of competence

  • Their professional role

  • Their organization’s policies

  • Applicable laws and regulations

  • BACB requirements

  • Licensure requirements

  • Payer or funding-source requirements

  • Confidentiality and recordkeeping standards

Products should not be used as automatic or universal treatment recommendations.

10. Confidentiality and Protected Information

Digital products may include forms, templates, worksheets, or documentation tools that are capable of containing confidential information.

Purchasers are responsible for:

  • Protecting client and participant confidentiality

  • Using secure storage and transmission methods

  • Obtaining required consent or authorization

  • Complying with HIPAA and other applicable privacy requirements

  • Following employer and organizational policies

  • Removing identifying information before sharing materials for consultation or training

Dani Elle Mentorship & Consulting is not responsible for confidential information entered into, stored in, or transmitted through a purchased product.

11. Artificial Intelligence and Automated Systems

Digital products may not be uploaded into public or third-party artificial intelligence systems for the purpose of:

  • Replicating the product

  • Creating substantially similar commercial products

  • Training an artificial intelligence model

  • Extracting proprietary frameworks or content

  • Redistributing or publishing the material

  • Generating products for resale

You may use AI-assisted tools for limited personal customization only when the tool’s privacy, confidentiality, and data-use terms are appropriate and the use does not violate this license.

Do not upload confidential client information into an AI system unless the use is authorized, secure, and compliant with applicable requirements.

12. Resale and Commercial Exploitation

You may not:

  • Resell the original product

  • Sell an edited or reformatted version

  • Include the product in a bundle for sale

  • Use portions of the product in another commercial resource

  • Publish the product in a book, article, course, website, database, or app

  • Offer the product as a free download to promote your own business

  • Claim authorship or ownership

  • Transfer or sublicense your license to another person or organization

Written commercial licensing permission is required for any resale, republication, sublicensing, or derivative commercial use.

13. Third-Party Marketplaces

Products purchased through Teachers Pay Teachers or another authorized marketplace may also be governed by that platform’s terms, policies, and licensing rules.

When marketplace terms and this license both apply, the more restrictive provision will govern unless otherwise required by law or stated in the product listing.

14. Refunds

Because digital products are delivered electronically, purchases are generally non-refundable once accessed or downloaded.

Refunds may be considered for duplicate purchases, unresolved technical problems, or seller error in accordance with the Refund & Cancellation Policy.

A refund or payment reversal terminates the purchaser’s license to use the product.

15. License Violations

Violation of this license may result in:

  • Immediate termination of the license

  • Revocation of access to products or services

  • Removal from memberships or platforms

  • Invoicing for the appropriate organizational or commercial license

  • A request to remove or destroy unauthorized copies

  • Reporting infringement to the applicable marketplace or platform

  • Legal action when appropriate

Termination of the license does not entitle the purchaser to a refund.

16. Updates to Products and License Terms

Product content and license terms may be updated periodically.

Unless otherwise stated, purchase of a product does not guarantee access to future versions, revisions, updates, or replacement files.

The license terms in effect at the time of purchase apply to that purchase, except where later updates are required by law or accepted by the purchaser.
